Future Minds Club — Website & Membership Terms

1. Who We Are

These Terms & Conditions ("Terms") govern your access to and use of the website located at futuremindsclub.ca (the "Site") and the Future Minds Parent Circle membership (the "Membership"), operated by Future Minds Club ("FMC," "we," "us," or "our"), a business based in Vancouver, British Columbia, Canada. Contact us at hello@futuremindsclub.ca.

By accessing or using the Site — including browsing, signing up for our email list, purchasing a product, joining the Membership, or participating in any FMC community or program — you agree to be bound by these Terms. If you do not agree, please do not use the Site or the Membership.

2. Who Can Use the Site

The Site, the Membership and our content are intended for use by adults (parents, caregivers, and educators) on behalf of children. The Site is not directed at children, and we do not knowingly collect personal information directly from children under the age of 13 (or the applicable age of consent in your region). Any journals, activities, or games designed for kids are meant to be used under the supervision of a parent or guardian.

If you are a parent or guardian and believe your child has provided us with personal information without your consent, please contact us at hello@futuremindsclub.ca so we can remove it.

You must be at least 18 years old, or the age of majority in your province or country, to make a purchase, join the Membership, create an account, or enter into these Terms.

3. Our Products and Content

FMC creates neuroscience-informed journals, digital tools, educational content, and parent support for children roughly ages 5–12 and their parents, including content featuring our characters Nova & Zeno.

Our journals, Membership content, live sessions, articles, social content, advisor Q&A, and any related materials are intended for educational and developmental enrichment purposes only. They are not a substitute for professional medical, psychological, psychiatric, or educational advice, diagnosis, or treatment, and participating in the Membership does not create a therapist–client relationship with FMC or any of our advisors. If you have concerns about your child's development, mental health, or wellbeing, please consult a qualified professional.

4. Intellectual Property

All content on the Site and in the Membership — including text, graphics, logos, the Nova & Zeno characters and artwork, journal designs, illustrations, videos, guides, and downloadable tools — is owned by FMC or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may view, download, and print content for your own personal, non-commercial, family use only. You may not reproduce, distribute, modify, publicly display, sell, or create derivative works from any FMC content — including journal pages, Membership materials, or Nova & Zeno artwork — without our prior written permission. Purchasing a journal or a Membership does not grant you rights to reproduce, share, or resell its content.

"Future Minds Club," the FMC logo, "Nova & Zeno," and related marks are trademarks of FMC. You may not use them without our written consent.

5. Purchases

Pricing & Availability. All prices are listed in CAD (Canadian dollars) and are subject to change. We reserve the right to limit quantities, refuse orders, or discontinue products at our discretion.

Payment. Payment is processed securely through our third-party payment providers (for example, Shopify Payments for products and Stripe, through Circle, for the Membership). By providing payment information, you represent that you are authorized to use that payment method.

Order Acceptance. Your order is an offer to purchase; we may accept or decline it for any reason, including product availability, pricing errors, or suspected fraud.

Pre-orders. Where a product is marked as a pre-order, the estimated shipping date is shown on the product page. Your card is charged when you place the order.

Shipping. Shipping timelines and costs are provided at checkout and are estimates only; we are not liable for carrier delays.

Returns & Refunds for Products. All product sales are final. We do not offer returns or refunds for change of mind. If an item arrives damaged, defective, or incorrect, contact us at hello@futuremindsclub.ca within 7 days of delivery with your order number and photos of the issue, and we will arrange a replacement or refund at our discretion. Membership refunds are covered in Section 6.

6. Future Minds Parent Circle Membership

What it is. The Membership is a paid, recurring subscription that gives you access to our private online community and member content, hosted on the Circle platform (circle.so). Membership benefits are described on the Membership page and may evolve over time as we grow the program.

Plans. The Membership is offered as a monthly plan or an annual plan. Founding Member pricing is available to the first 50 members only, while spots remain.

Automatic renewal. Your Membership renews automatically at the end of each billing period (monthly or yearly) and your payment method is charged the price in effect for your plan, until you cancel. If the price of your plan changes, we will notify you by email at least 30 days before the new price applies to you.

Cancelling. You can cancel at any time from your account settings in the Circle community, or by emailing hello@futuremindsclub.ca. Cancellation stops future renewals. You keep access until the end of the billing period you have already paid for.

Refunds.

Monthly plan: monthly payments are non-refundable, and we do not refund partial months.
Annual plan: if you cancel within 14 days of your first annual payment, you may request a full refund by emailing hello@futuremindsclub.ca. After 14 days, annual payments (including renewals) are non-refundable, and you keep access until the end of your paid year.
If we discontinue the Membership, we will refund the unused portion of any prepaid fees.

Member pricing. Member discounts on FMC products and events are available only while your Membership is active and are for your personal use.

Community guidelines. Please treat other members with kindness and respect, keep what members share in the community private, and do not post promotional content, spam, or identifying images of children without their parent's consent. We may remove content or suspend or end a Membership, without refund, for serious or repeated breaches of these Terms or of any community rules posted in Circle.

Circle. Your use of the Circle platform is also subject to Circle's own terms and privacy policy. Where Circle's community terms and these Terms differ on matters between you and FMC, these Terms apply.

7. Email List, Waitlist & Community Programs

If you subscribe to our email list, join a waitlist, or participate in a program such as Founding Families, an ambassador program, or a focus group, you agree to receive communications from us related to that program. You can unsubscribe at any time using the link in our emails or by contacting us. Participation in any community, giveaway, or ambassador program is subject to any additional rules posted for that program.

8. User-Generated Content & Testimonials

If you submit feedback, testimonials, photos, reviews, or other content to us (for example, through a focus group, survey, social media tag, email, or a public area of our community), you grant FMC a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, and display that content — including in our marketing, on the Site, and on social media — unless you tell us otherwise in writing. We will not use content you share in private member spaces in our marketing without your permission, and we will not knowingly post identifying images or content of a child without a parent or guardian's consent. You represent that you have the right to submit any content you provide and that it does not infringe on anyone else's rights.

9. Acceptable Use

You agree not to use the Site or the Membership for any unlawful purpose or in violation of these Terms; attempt to gain unauthorized access to the Site, our systems, or other users' accounts; share your Membership login with others; upload viruses or malicious code or disrupt the Site; scrape, copy, or reuse content for commercial purposes without permission; or impersonate any person or misrepresent your affiliation with FMC.

We may suspend or terminate your access to the Site, the Membership, or any account if we believe you have violated these Terms.

10. Third-Party Links & Services

The Site and Membership use or link to third-party services (for example, Shopify, Circle, Stripe, Instagram, and our print partners) that we do not control. We are not responsible for the content, policies, or practices of any third-party site or service.

11. Disclaimer of Warranties

The Site, the Membership, and our content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted by law. We do not guarantee that the Site or Membership will be uninterrupted, error-free, or secure, or that our products or Membership will produce any particular developmental or educational outcome.

12. Limitation of Liability

To the fullest extent permitted by law, FMC and its owners, employees, advisors, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site, the Membership, or our products. Our total liability for any claim will not exceed the amount you paid to FMC in the twelve months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits any rights you have under applicable consumer protection law.

13. Indemnification

You agree to indemnify and hold FMC harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Site or Membership, your violation of these Terms, or your violation of any rights of a third party.

14. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.

15. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date at the top will reflect the most recent revision. If we make a material change that affects active members, we will let members know by email or in the community. Continued use of the Site or Membership after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. Any disputes will be resolved in the courts located in British Columbia, Canada.
